Terms and Conditions
These terms are between you and GTS Performance LLC of Newark, Delaware ("GTS", "we"). They cover tunedbygts.com, the GTS flashing software, and every calibration, part and service we sell. Our Warranty and Returns page and our Privacy Policy are part of these terms. Placing an order or using the software means you accept them.
The short version:
- You buy a license to run our calibration on one ECU in one car.
- The car's mechanical health, its fuel and how you drive it are your responsibility.
- We back the calibration with a one year limited warranty and a 30 day return window. Details on the Warranty and Returns page.
- Talk to us before you dispute a charge. Most problems are a log and a revision away.
What you are buying
A calibration is licensed, not sold. The license is for one ECU in one vehicle, the one you ordered it for. You may not copy the calibration, read it out of the ECU to use elsewhere, modify it, share it or resell it. Your original calibration is read and kept before anything is written, and you can go back to stock whenever you want to.
The GTS flashing software is licensed to customers with an active account, for their own cars. We may revoke the license and software access if these terms are broken.
Selling the car: the next owner can take the tune over for a transfer fee. Email us with your order number and the new owner's name and email address, and we move the license to their account.
Replacing the ECU: a calibration for a different ECU is a new flash. Email us before you swap it.
Ordering and delivery
- Your information: the calibration is written for the engine code, hardware and fuel you give us when you order. Check them. A calibration built on wrong information is not a defect.
- Remote delivery: the GTS cable ships with your first order for a one time $40 and a flat $11 shipping charge, and it is yours to keep. Our software reads your ECU, we write the calibration, and you flash it yourself. You need a Windows laptop, a stable internet connection and a healthy battery or a charger on the car.
- Mail-in: where offered, you ship us the ECU, we flash it on the bench and send it back.
- Turnaround: most calibrations and revisions come back the same day, and within 72 hours at the outside. Those are typical times, not promises. If yours will take longer, we tell you.
- Logs and revisions: included in the price of every tune.
- Pre-orders: a part marked pre-order ships when stock arrives. You can cancel for a full refund until it ships.
Your car and your responsibility
A tune raises the load on every part of the car. Before and after you flash:
- The engine, turbo, clutch, transmission and drivetrain have to be in good health. A tune does not fix a worn part, it finds it.
- Run the fuel the calibration was written for, every tank.
- If something feels wrong, stop, log it and send us the log. Do not keep driving on a problem.
- Do not interrupt a flash. Keep the laptop plugged in, the cable seated and the battery charged. A flash that stops halfway can leave the ECU unable to start, and recovering it can mean a mail-in.
- A tune can be seen by a dealer and can affect the manufacturer's warranty. Our CVN and CAL ID guide explains how.
- The GTS software talks to the ECU and to us. We never ask for remote access to your computer, and you should not give it to anyone who claims to be us.
You are responsible for the condition of the car, the fuel in it and the way it is driven. We are not responsible for the mechanical failure of an engine, turbo, transmission or drivetrain component, or for the cost of repairs, towing or downtime.
Competition use and emissions
Competition features such as antilag and hard 2-step, and calibrations written for race fuel, are for off-road and closed course use. Some states, California among them, restrict aftermarket engine software on emissions-controlled vehicles. You are responsible for the rules where your car is registered and driven. We do not sell emissions deletes and we do not remove emissions equipment from a calibration.
Warranty
Our calibrations and turbo kits carry a one year limited warranty, and other hardware is covered against arriving dead. The terms are on the Warranty and Returns page and are part of this agreement.
EXCEPT FOR THAT LIMITED WARRANTY, OUR CALIBRATIONS, SOFTWARE, PARTS AND SERVICES ARE PROVIDED AS IS. ANY IMPLIED WARRANTY, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE DURATION OF THE LIMITED WARRANTY. SOME STATES DO NOT ALLOW LIMITS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMIT MAY NOT APPLY TO YOU.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, GTS IS NOT LIABLE FOR DAMAGE TO AN ENGINE, TURBO, TRANSMISSION, DRIVETRAIN OR ANY OTHER PART OF A VEHICLE, FOR REPAIRS, TOWING, LOSS OF USE OR DOWNTIME, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM OUR CALIBRATIONS, SOFTWARE, PARTS OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE THE CLAIM IS ABOUT. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
Support
Support covers the installation and use of GTS calibrations and the GTS software: getting the cable talking to the ECU, reading logs, and revising the calibration. It is a conversation with the people who wrote the software, in English or Spanish, Monday to Friday, 9 am to 5 pm Eastern. It does not cover third party hardware or software, or diagnosing a worn engine, though the logs often point at one. Support goes with the license. If the license ends, so does support.
Payments and chargebacks
Prices are in US dollars. Card payments are taken on our payment processor's secure page, never on our own server. We accept Canadian cards.
Talk to us before you dispute a charge. Most problems are a log and a revision away, and a refund that is owed is paid without a fight. A chargeback filed without contacting us is answered with the order and the flasher delivery record. A chargeback on a calibration that has been delivered ends the license and your access to the GTS software, and we reserve the right to recover the amount and the dispute fee through the legal means available to us.
Your account
Keep your password to yourself. You are responsible for what happens under your account, and for keeping the email address on it current, because that is where the notice goes when your calibration is ready.
Reviews and what you send us
Logs you send are used to tune your car. Reviews you post appear on the site with the name you enter, and we may remove one that is abusive or off topic.
Ending the agreement
We may end the license and your software access if you copy, share or resell a calibration, dispute a charge for a delivered calibration without talking to us first, or abuse our support. The Warranty and Returns page says what, if anything, is refunded. You may stop using the calibration at any time by flashing your original calibration back.
Changes to these terms
We may update these terms. The date at the top tells you when we last did. Orders placed after a change are under the new terms. Orders placed before it stay under the terms that applied when you bought.
The legal part
Delaware law governs these terms. Any dispute is brought in the state or federal courts in Delaware. If part of these terms cannot be enforced, the rest still stands. These terms, the Warranty and Returns page and the Privacy Policy are the whole agreement between you and GTS.
